Initiatives of the Economic Council of the Municipality of Derventa

All members of the Economic Council have the right to initiate a public-private dialogue on the issue of improving the business environment (amendments and amendments to local regulations, improvement of existing or introduction of new services, reduction of communal fees and fees, definition of new incentive packages, definition of criteria for awarding incentives, change of the curriculum in accordance with the needs of the economy), improvement of the competitiveness of small and medium-sized enterprises, market analysis, development of a certain sector, creation of value chains, strengthening of cooperation between institutions at the local level, proposals for amending regulations at higher levels levels of government, etc.

It is necessary that every initiative is aimed at achieving some systemic solution (for example, changing regulations at the local level, changing laws at a higher level, introducing new functions, better position of local SMEs in the market) which, in the long term, will affect the improvement of the business environment, the competitiveness of small and medium-sized enterprises, the competitiveness of the local community, etc.

The initiative can come from representatives of the public or private sector.It is recommended that members of the Economic Council accept initiatives by consensus, and if this is not possible, by a two-thirds majority. Each meeting of the Business Council should result in a certain number of initiatives, which are recorded in the minutes, which are sent to all members of the Business Council, regardless of whether they were present at the meeting or not.

In order for an initiative to enter the resolution procedure, it is necessary for the LED officer, as the technical secretary of the Economic Council, to elaborate and define the initiative in more detail, in the form of a concept with a clearly defined proposal of steps and a time frame in a way that is understandable for all members of the Economic Council and important actors who will participate in the implementation of the initiative. In order to develop the concept, it may be necessary for Economic Council, or the responsible member(s) of the Business Council to conduct additional research and gather additional information.

The initiatives of the Economic Council are referred for further resolution to the competent institution at the local level or to higher levels of government.The Technical Secretary of the Business Council will regularly inform all members about the progress of the resolution and the outcome of the initiated initiative at the meetings of the Business Council, as well as through reports. The report on the outcome of the implemented initiative should be clear, concrete, concise, with a brief overview of the steps taken and evidence of implementation (in the annex of the report). The report should also contain recommendations for further work, that is, new initiatives that resulted from the implemented activities. If, for certain reasons, the initiative could not be realized, the report will also contain an analysis of the steps taken and the causes of the failure.

Overview of proposed initiatives

Initiative 1: Improving the workforce in the metal sector (December 22, 2016)

In response to this initiative, an analysis of the supply and demand for labor in this sector was carried out (an analysis of the number of students who are currently studying according to educational profiles for the metal sector in secondary schools in Derventa, in relation to the expressed needs of the private sector (in January 2018). A survey was also carried out, with the aim of determining the needs and directions of development of economic entities operating in the metal sector (June-July 2018).In 2018, mechanisms were also established for the improvement of the workforce in the metal sector, as a partnership between the public and private sectors: the municipality of Derventa allocated 40,000 KM for the arrangement of space for conducting practical classes for vocational high school students. Business entities also participate in the financing of this initiative.

Initiative 2:  Determination of businessmen’s investment plans in the next year (expansion of production capacities) and determination of labor needs in those capacities (December 22, 2016)

In response to this initiative, a survey of the needs in the metal sector was conducted (see Initiative 1), and a survey of the needs of businessmen in the shoe sector, as the second most promising sector in the municipality of Derventa, is also planned.

Initiative 3: Construction of workers’ apartments 01.06.2017

Initiative of individual employers to build residential units for their employees (subsidized apartments). In this way, the workers would be kept in Derventa because of the real estate. This is, in fact, an initiative of the workers.  The role of the municipality should be: construction of communal infrastructure (water supply, sewerage, lighting, support in the construction of the electricity network, provision of land at a favorable price (because it is zone VI, VII). The municipality has already created the conditions for the implementation of this initiative, and it is necessary to initiate other businessmen to get involved in its implementation. In this way, the workforce would be further motivated and stimulated and the competitiveness of SMEs in Derventa would be further strengthened.

Initiative 4: Obligation to register real estate and pay taxes as a prerequisite for receiving incentives for agricultural production (June 22, 2017)

Based on the Agricultural Production Incentives Program in the Derventa Municipality, agricultural producers exercise the right to agricultural production incentives, based on applications submitted to the Department of Economy and Social Activities of the Derventa Municipality, if they meet the conditions stipulated by the Program. Given that considerable funds have been continuously allocated from the Municipal Budget for these purposes for a number of years, and that at the same time not all applicants for incentive funds have reported real estate to the Tax Administration of the RS for the purpose of determining tax obligations, nor have they paid tax obligations, this initiative was initiated by the Municipal Administration of Derventa and the Mayor of the Municipality. In connection with the above, an initiative was also launched that all those who do not fulfill this legal obligation, in accordance with the legal provisions, should be sanctioned.

Initiative 5: Improving Private Sector Information

Businessmen in the footwear and metal sectors, but also in other sectors of the economy, face a lack of information essential for business. It is necessary to introduce the function of informing companies, especially in connection with frequent changes in regulations. In the Chamber of Commerce of the Republic of Srpska, where the company “Sanino”, d.o.o. active member, they recognize problems and report them to the RS Government and higher authorities, but they mostly turn a deaf ear. The biggest problems are the frequent changes in laws and regulations and the inconsistency of many regulations with the needs of the economy and other processes, such as EU integration. SMEs find it very difficult to find their way in the forest of regulations and inconsistency of information about them. The company is fined without being previously informed about the new law or regulation.

Initiative 6: Submitting an initiative to the competent institution to abolish the obligation to pass the sanitary and hygienic minimum every 4 years (joining the initiative of the municipality of Prnjavor) (October 17, 2017)

The businessmen of Derventa join the initiative of the municipality of Prnjavor from September 28, 2017. year and they agreed that the initiative should be launched jointly.. Every legal entity and entrepreneur from the sector subject to sanitary and hygienic regulations is obliged to send all employees to pass the sanitary and hygienic minimum for 4 years. The application costs 80 KM per employee. If the employee leaves the job, he takes the certificate with him, and new employees must go to take it. This regulation particularly affects large employers, who on an annual level have significant expenditures for these needs. Given that the procedure and the examination are always of the same content, renewing certificates for the same employees is, according to the initiator of the initiative, pointless.The proponents demand that the outdated regulations be reviewed and revised, and that the passing be one-time or, if that is not possible, that the renewal of the exam be free of charge. In addition, businessmen recommend the legislator to harmonize regulations with modern standards in relevant areas, such as HACCP, which has even more rigorous sanitary-inspection requirements than the existing law, and to release those who operate with this certificate. PS members also pointed out that the regulations that regulate this originate from the time when unqualified workers performed jobs that are subject to sanitary and hygienic minimums, and that today these jobs are mostly performed by trained personnel who learn the relevant regulations and procedures as part of regular education. The proponents of the initiative demand that all circumstances be examined and a report on the current situation be prepared, based on which a letter would be sent to the competent republican authorities for the revision of such legal and by-laws.
